Eligibility, Low Income Housing Tax Credit

The Low Income Housing Tax Credit (LIHTC or Tax Credit) program was created by the Tax Reform Act of 1986 as an alternate method of funding housing for low- and moderate-income households, and has been in operation since 1987.

In addition to the common criteria for all SROs and family apartments, the following criteria apply for eligibility at Low Income Housing Tax Credit locations:

     
Criteria #1: Student Status
 
  • SRO's - Full time students cannot live at either the Waldorf or DePaul Residences. Part time student status is acceptable but must be documented.
  • Family Apartments - If the occupant or if all the occupants of a unit are full-time students, the unit will not be considered a qualifying tax credit unit unless one of the full-time students is:
    A single parent with children, none of which are declared as dependents on another Person’s tax return.
    Married and filing a joint federal tax return.
    Receiving AFDC payments on behalf of minor children.
    Enrolled in a job-training program receiving assistance under the Job Training Partnership Act or funded by a state or local government agency.
Criteria #2: Income limits
 
  • A Tax Credit Unit can be occupied by any household whose income does not exceed the maximum allowable income for their household size.
